Introduction

Holcim (US) Inc., along with its parent company and subsidiaries ("Company" or "We") respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes:

  • The types of information we may collect or that you may provide when you download, install, register with, access, or use the CONCRETELY APPLICATION (the "App").
  • The types of information we collect on the CONCRETELY website at www.concretely.co.
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

Our websites and apps, and these other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Scope of Policy

This policy applies to our collection, use and disclosure of your personal information on our behalf.

This policy applies only to information we collect in this App and in email, text, and other electronic communications sent through or in connection with this App and its corresponding website www.concretely.co.

This policy DOES NOT apply to information that:

  • We collect offline or on any other Company apps or websites, including websites you may access through this App.
  • Our business customers choose to upload to this App over and above information that we have requested for the purposes set out herein.

This policy does not ‎impose any limits on the collection, use or disclosure of information that is not personal information under applicable laws, including, depending on the jurisdiction, business contact information or certain publicly-available information.‎ Notwithstanding the foregoing, the Company strictly abides by all relevant antitrust laws and regulations and shall not collect any potentially competitive or sensitive information or share said information with its respective affiliates that may compete in the same markets of the Users of the App.

We have designated a Privacy Officer who is responsible for our compliance with this policy. The Privacy ‎Officer may be contacted as described below under Contact Information.‎

Information We Collect and How We Collect It

We collect information from and about users of our App:

  • Directly from you when you provide it to us.
  • Automatically when you use the App.

Information You Provide to Us

When you request a demo, download, register with, or use this App, or create a user account, we may ask you to provide information:

  • By which you may be personally identified, such as name, postal address, email address, company name, telephone number, or any other information the App collects that is defined as personal or personally identifiable information under applicable law /any other identifier by which you may be contacted online or offline ("personal information").

This information includes:

  • Information that you provide by filling in forms in the App. This includes information provided at the time of registering to use the App, subscribing to our service, and posting material. We may also ask you for information when you report a problem with the App.
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
  • Details of transactions you carry out through the App and of the fulfillment of your orders.
  • Your search queries on the App.

If applicable, you may also provide information for publication or display on public areas of the App or websites you access through the App (collectively, "User Contributions"). Your User Contributions are posted and transmitted to others at your own risk. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

When you download, access, and use the App, it may use technology to automatically collect:

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, logs, and other communication data and the resources that you access and use on or through the App.
  • Device Information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
  • Location Information. This App does not collect real-time information about the location of your device. The App includes functionality that (typically through integration with a GPS system that your business has in place) uses the location of your business’s concrete trucks to enable multiple App features.

If you do not want us to collect this information, do not download the App or delete it from your device.

How We Use Your Information

We collect, use, and disclose information about you or that you provide to us, including any personal information, to:

  • Provide, operate, maintain, and improve the App and its contents, and any other information, products, or services that you request from us.
  • Schedule demos of the App.
  • Create user accounts.
  • Provide customer service and otherwise communicate with you.
  • Conduct marketing and advertising.
  • Authenticate your identity.
  • Provide information to third-party providers of products and services (as described in more detail below).
  • Maintain accurate records.
  • Give you notices about your account, including expiration and renewal notices.
  • Protect us, yourself, and others from fraud and error and to safeguard our business interests.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us (including the App End User License Agreement/Terms of Service), including for billing and collection if applicable.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • Notify you when App updates are available, and of changes to any products or services we offer or provide though it.
  • Assess and administer our business, accounting, auditing, compliance, recordkeeping, and legal functions.
  • As otherwise required or authorized by law.

The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our App according to your individual interests.
  • Speed up your searches.

When your personal information is to be used for a purpose not previously identified, we will disclose that ‎the new purpose to you before that use, and if required by applicable law we will seek your consent unless the use is authorized or ‎required by law.‎

Disclosure of Your Information

We may disclose aggregated information about our users and information that does not identify any individual/business, in accordance with applicable law.

We will not share personal information we collect from you with any third party, except as indicated in this policy or as permitted or required by law.

We may disclose or transfer personal information that we collect or you provide:

  • To contractors, service providers, and other third parties in relation to our business, the App, or ‎other products or services that we provide. If we require a third party to deal with your personal ‎information for these purposes, where required by law we will take reasonable steps to ensure that the third party adheres to privacy ‎procedures and will keep your personal information confidential and use it only for the purposes for which we disclose or transfer it to them.
  • To a buyer or other successor in the event of a potential or actual merger, divestiture, restructuring, reorganization, investment, dissolution, or other sale or transfer of some or all of our assets, shares, or business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce our rights arising from any contracts entered into between you and us, including the App Terms of Service and for billing and collection if applicable.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • For any other purpose disclosed by us when you provide the information.
  • For any other purpose with your consent.

The parties to whom we may disclose or transfer personal information as described above may be located outside of your jurisdiction of residence, and you acknowledge that personal information ‎may be processed and stored in foreign jurisdictions with different privacy laws, and ‎that applicable laws in those other jurisdictions might permit foreign governments, courts, law enforcement or regulatory agencies to access the information in those jurisdictions. In these cases, we will comply with applicable local law requirements relating to the conditions for disclosure or release of personal information.‎

Consent

Where required by applicable law, we will obtain your consent to collect, use or disclose personal information except where we are ‎authorized or required by law to do so without consent. Your consent can be express, implied or given through an authorized representative such as a lawyer, ‎agent or broker.‎ Consent may be provided orally, in writing, electronically, through inaction (such as when you fail to notify ‎us that you do not wish your personal information collected/used/disclosed for various purposes after you ‎have received notice of those purposes) or otherwise.‎

You may withdraw consent at any time, subject to legal, contractual and other restrictions, provided that ‎you give us reasonable notice of withdrawal of consent. If you notify us that you withdraw consent, we ‎will inform you of the likely consequences of that withdrawal of consent, which may include our inability to ‎provide certain services for which that information is necessary.

Limits on Collection of Personal Information

We will not collect personal information indiscriminately but will limit collection of personal information to ‎that which is reasonable and necessary. We will also collect personal information as required or authorized by law.‎

Limits for Using, Disclosing and Retaining Personal Information

Your personal information will only be used or disclosed for the purposes set out above and as authorized ‎by law.‎

We will destroy, erase or make anonymous documents or other records containing personal information ‎as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the ‎information and retention is no longer necessary for a legal or business purpose.

Accessing and Correcting Your Personal Information

You can review and change your personal information by logging into the App and visiting your account profile page.

Residents of certain jurisdictions may have a right to request access to, correct, or delete personal information. If you are entitled to exercise such rights, you may send us an email at support@concretely.co to request. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

Note that if we receive a request from an individual employee of one of our customers, we may route that request to the customer to handle. We may also reject deletion requests if doing so would impact our ability to send invoices or collect unpaid balances.

If you demonstrate the inaccuracy or incompleteness of personal information, we will amend the ‎information as required. If appropriate, we will send the amended information to third parties to whom ‎the information has been disclosed. ‎If a challenge regarding the accuracy of personal information is not resolved to your satisfaction, we ‎will annotate the personal information under our control with a note that the correction was requested ‎but not made.‎

We may need to request specific information from you to help us confirm your identity and ‎ensure your right to access the information (or to exercise any of your other rights). This is ‎another appropriate security measure to ensure that personal information is not disclosed to any ‎person who has no right to receive it.

In some situations, we may not be able to provide access to certain personal information (e.g., if ‎disclosure would reveal personal information about another individual, the personal information is ‎protected by privilege, the information was collected for the purposes of an investigation ‎or where disclosure of the information would reveal confidential commercial information that could harm ‎our competitive position). We may also be prevented by law from providing access to certain personal ‎information.‎

If we refuse your request, we will notify you in writing, document the reasons for refusal and ‎outline further steps that are available to you.‎

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, collection, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you a temporary password for access to certain parts of our App, you are responsible for changing the password immediately to a strong and unique password, and keeping that password confidential. You should not share your password with anyone. We urge you to be careful about giving out information in public areas of the App like message boards.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we take the measures described above to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App, or that ‎hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify ‎your information. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Children’s Privacy

Our App and website are not designed for children, and we do not knowingly collect personal information from children under 18. If you are a parent or legal guardian and you believe we have collected your child’s information in violation of applicable law, please contact us using the contact information in the Contact Information section below.

Browser Signals/Do Not Track

Our site currently does not respond to “Do Not Track” signals. However, our site may respond to other opt-out preference signals as may be required by law.

Changes to Our Privacy Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users' personal information, we will endeavor to notify you by email to the email address specified in your account and/or through a notice on the App home page for a reasonable time before and after the changes take effect. Where required by applicable law, we may need to ask you to confirm your consent to the ‎processing of your personal information. Otherwise, your continued access to or use of the App constitutes your acknowledgment and acceptance of the applicable ‎changes.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
